Crystal Palace 3,776,000 Pulis 0 I guess that's one defence Pulis couldn't organise . I believe unimpressed is a legal nice way of questioning the authenticity of one's statement. Morally undoubtedly TP was due some of this bonus, legally he hadn't a leg to stand on, the most expensive 2 weeks holiday in history.

Christ, this legal stuff is complex. Call me Mr Thicky but was this a case of a Pulis claim and then a Palace counter claim. What exactly was the grounds for a Pulis claim?.

Despite what people thought of him as a football manager, you have to be a bit thankful that Pulis' relationship with PC was so good that this nasty business never tarnished our club or TP's time with us.
That'd be a real shame.

Ouch.
What a greasy, untrustworthy little man.
Thanks for everything, but I'm so glad we moved on from TP.

Christ, this legal stuff is complex. Call me Mr Thicky but was this a case of a Pulis claim and then a Palace counter claim. What exactly was the grounds for a Pulis claim?. Palace won the initial claim and were awarded 3.7 Million back in April (2.2 Mill cost of Bonus and 1.5 Mill damages and interest) Pulis appealed under a Sec 68 and it looks like the whole thing was balanced on the date of a HPM (Heated players Meeting) which Pulis cites as the reason for quitting and the early bonus for buying land Both the HPM Date & Land Purchase have been found to be fraudulent in this Appeal and a final claim regarding Corporation Tax benefits (To try and lower the interest charged) also thrown out by the Judge. Edit : there was also a squabble about Pulis only getting £900 ish thousand and that the 1.3 Mill taxes & NI should be recoverable by CPFC but there's no guarantee of that so CPFC have agreed that if they do get it back they'll pass it onto Pulis.

Christ, this legal stuff is complex. Call me Mr Thicky but was this a case of a Pulis claim and then a Palace counter claim. What exactly was the grounds for a Pulis claim?. IMO it was essentially this: ".......... under his contract of employment the Claimant was due to be paid a bonus of £2 million gross, if he successfully kept Crystal Palace in the Premier League after the 2013/2014 season, which he did, and if he remained in employment on 31 August 2014, which latter condition was in the event not fulfilled. In early August 2014, ie some two weeks or so before the date of 31 August, the Claimant requested early payment of the £2 million bonus and the Defendant acceded to this request, paying him on 12 August 2014. On the following evening, 13 August, the Claimant informed the Defendant for the first time that he wanted to leave the club and he did so the following day."I can only deduce that when Pulis received early payment that he (and his advisors?) presumed/believed/assumed that it meant he had been released from the condition that he had to remain in employment till 1st September. Palace took a different view and the court have sided with them. I can also only assume that Pulis brought the appeal on the grounds of "natural justice" and that Palace had a "duty to act fairly". I think we all know how much natural justice there is in the world, particularly where money is concerned.

That'd be a real shame. That would be because along with his P45, PC gave him a nice big cheque, if it had just been the P45 I suspect he might not have played so nicely.

I'd imagine a certain Mr Scally of Gillingham will be breaking open a big bottle of champers when he reads this judgement. I have to say that (even though I was a Pulis supporter until the last few months of his time with us) this case leaves a rather nasty taste in the mouth. I think that, if I were in TP's shoes and had wanted to terminate my contract early, I would have accepted that, either I would lose the bonus or, at the very least, I would have honoured my contract until such time as I actually became entitled to the bonus. It does seem that the more some people have the more greedy they get. TP gets an annual salary which is beyond anything which his father could have dreamed of earning in his lifetime and to adopt devious means to try to swindle a £2 million bonus (to which he was not entitled) out of Crystal Palace really is depressingly greedy and mean spirited.

I think we all know how much natural justice there is in the world, particularly where money is concerned. Your assumption is wrong it's in the detail on the 8th August he confirmed he would stay on as manager, was given the cash to buy a piece of land, then following a heated players meeting (date he seems unsure of) he decided he no longer wanted to stay on and walked out 2 weeks before the start of the season and before the payment was due Judge also states he believed this was because he was trying to get a better paid job.

I think we all know how much natural justice there is in the world, particularly where money is concerned. In reality he appealed using 2 fraudulent claims 1. He hand some landed to purchase 2. He was happy with the Job, received the Bonus early, had a major row with players that same day and decided he couldn't carry on with the job because of it. Also alongside the appeal he's fought to bring down the damages by saying CPFC will claim back the taxes (Which they might) so he shouldn't be liable for it, nor the interest on top of it, and also that CPFC have benefited from a lower Corp tax bill due to his Bonus so that should in turn reduce the interest on the damages even tho CPFC had already agreed a lower than normal interest rate on the damages awarded. There's no doubt Pulis did an amazing Job for Palace, but he signed a contract to keep them up and be in charge the following season, the latter part he didn't stick to for whatever reasons known only to him.

Am I reading this right that if he waited another 18 days then he'd have been entitled to the bonus with no recourse from CPFC?
If that's correct he got some shocking advisors working for him!

If TP can afford to pay £3.7 million from his own funds, it just shows you don't need to feel too sympathetic for a sacked top flight football manager.

He must be incredibly thick to have done something so stupid having earned every penny of his £2m to keep CP in the Prem. Surely he could have told the club he planned to join he would not be able to do so until the end of August. He perhaps thought that he was "only" risking the net bonus of £900k, which he would have more than covered during the season with generous salary and bonus arrangements at his new club, with possibly a "golden hello" payment upon him joining. These payments might otherwise have been lost to him if his new employers were not prepared to wait until after the season had started. What he would not have anticipated was that he would have to cover the NI and PAYE (£1.1m), potentially irrecoverable by CP from HMRC, and £1.5m of damages in addition. Those unforeseen consequences have turned what would have been a bit of a blow of having to repay "just the £900k" into a complete disaster for him.
I guess he is a very wealthy man but if he ends up with a bill of £5m including legal costs, that must make a very significant dent in his wealth.

It's not the first time he's pulled stuff like this though. He obviously thought he could do it again and has been caught out this time. He was fortunate that the court case with Gillingham was resolved because that involved him blackmailing the chairman.
