02STEVE NICHOLSON EFL statement EFL STATEMENT: DERBY COUNTY On 2 July 2021, the EFL published the written reasons relating to an Independent Disciplinary Commission’s sanction verdict in respect of earlier proceedings between the EFL and Derby County. Alongside a financial penalty of £100,000, the Club received a reprimand as to its future conduct and was ordered to submit revised and restated accounts for the years ended 30 June 2016, 30 June 2017, and 30 June 2018 to the EFL by Wednesday 18 August 2021. Following constructive discussions between the Club and the EFL it has now been agreed to extend this deadline, with the necessary filings now required by Tuesday 24 August 2021. The EFL will be making no further comment on this matter at the current time. And I'm sure they'll be posted by next Tuesday. To those who know more than I on this, will Derby have posted accounts to HMRC and theses are simply additional accounts designed for HMRC? Or are these additional requirements for the industry? In a statement, the EFL said: 'The club has also been ordered to file restated accounts for financial years ending 30 June 2016, 2017 and 2018 that meet the requirements of FRS102, together with updated Profit & Sustainability calculations if necessary.

If that was us there'd be no "negotiation" of punishment. The EFL is supposed to be in charge of the league, this sounds more like a business deal between peers. Maybe the EFL is just trying to avoid another court date.

Derby are locked in talks with the EFL over striking a settlement on their punishment for breaches of financial regulations, in order to end the dispute that has dragged on for over 18 months.
Ahead of their 99th league meeting with local rivals Nottingham Forest on Saturday, Derby and their legal team have this week been in further negotiations to try and thrash out an acceptable deal for both sides.
Derby were initially charged in January 2020 over breaches of spending rules and cleared, but the EFL’s appeal over their accounting policies resulted in a £100,000 fine in June this year.
The club were then instructed to file restated accounts for financial years ending 30 June 2016, 2017 and 2018, with the deadline expiring on Tuesday this week.
Under pressure from rival Championship clubs, the EFL is pushing for Derby to be punished and it is understood that a deduction of 12 points - nine points plus a suspended three points - and an imposed business plan has been discussed, but is yet to be agreed.
Derby are already under a transfer embargo which restricts them to free transfers or short-term loans, while they will also be deducted three points if they fail to pay their players in any of the months this season.
The question now is whether Mel Morris, the Derby owner, reluctantly accepts the EFL’s proposed punishment or, as expected, challenges it. Derby have always maintained they did not seek any competitive advantage with their amortisation policy.
Morris is determined to sell the club, with talks ongoing with a number of parties, but is effectively in limbo until the situation is resolved.
He is also aware that a heavy punishment of up to nine points will severely impact Derby’s season and give manager Wayne Rooney a huge task to avoid relegation. Talks between Derby and the EFL, who both declined to comment, will continue but there is a clear sense that the saga must come to an end soon.
Both parties are keen to avoid another drawn-out legal battle which could go before another disciplinary commission.

Does make you wonder what value Rooney has added to WRDCFC. I’m sure that were he not there the EFL wouldn’t have pussy footed around, they didn’t with other clubs. They are just shitting themselves in the event of adverse media attention by upsetting an England favourite. They are a joke.

I can't remember this sort of approach with Macclesfield or Bury! I keep saying it: the trouble with the case against Derby is that all along they have asked and got approval for what they were doing from the League. Ask yourself why they have been asked to resubmit accounts for the previous 3 seasons as well as last year. Those accounts have been previously accepted by the League so they are on a very sticky wicket. If Derby get too harsh a punishment I've been told they won't hesitate to take the case to a court of law which could take up to 3 years to get heard and they are fairly confident they will win.

But the other half is that they're already two seasons behind every other club in submitting their amended accounts (I wonder why?), as well as failing to pay their players on time etc
As for the present hoo ha, the reason why the EFL is "negiotiating" is nothing to do with Rooney's iconic status, or Derby's bigger standing than Bury or Macclesfield, or fear of Morris etc.
As has been noted, were the EFL to impose the penalty they think is fitting, Derby would inevitably appeal to the Courts, which could take another 18 mths or two years to resolve. And in the meantime, the EFL has a league to run i.e. they don't want/need another Wycombe at the end of this season, another the season after and who knows, a third the season after that.
But the difference in this case from the usual, is that Derby don't want to drag this out either - Morris desperately wants to sell the club before it goes bust. Which gives the EFL much more leverage in the negotiations than is normally the case.
Finally, it is not true to say that you cannot "negotiate" over your taxes, as s.o. else claimed. I know s.o. who's quite senior in HMRC and he says they negotiate all the time. That is, they will often accept 60% or 70% of what they think they're owed if it's paid rightaway, rather than hold out for the full 100%, then find it takes years while it's dragged through the Courts, at the end of which they might get much less, or even nothing at all.
