if there is a fuck up in the pre-contract agreement i.e not making it conditional on obtaining a work permit then that is the fault of the lawyers acting for the club.
I think scholes and cartwright are totally fucking useless but that would not be their fault, I imagine solicitors prepare such documents and if so could be deemed to be negligent?

I don't fully understand this can someone explain simply? Is it that because we offered him a contract we have to pay his wages despite him not gaining a work permit Without seeing all the clauses of the pre-contract agreement, it is impossible to say what the true position is.
One thing is for sure, FIFA cannot overrule a legal contract/agreement.

Our recent loan signing is covering this cock up Why is this a 'cock up'? Juan Agudelo met all the criteria to gain a work permit. We got screwed ! Simples.

KKK lost a lot of credibility with me when he posted pictures of himself modelling the new shirt sat in front of his PC surrounded by compact discs.
It just screamed 'mentalist'.
I've never taken him seriously since.

And he was basically free. And he seems to be being courted by a number of very decent European clubs. Who we could sell him to. For a profit. Not going to lie. I've seen money spent worse. A lot worse. I agree.. Kenwyne Jones, Wilson Palacious...David Rowson

ive got a feeling KKK could be right
"In an attempt to release themselves from the obligations under a pre-contract, parties have attempted to allege that the validity of a pre-contract was conditional upon a player successfully completing a medical or obtaining a work permit however the DRC has rejected all such arguments on the basis that Article 18(4) of FIFA’s Regulations on the Status and Transfer of Players 2012 prevents the validity of a contract between a player and a club being “subject to a successful medical examination and/or the grant of a work permit.”

Have it on good authority that Carto & Scholes bought "Juan Agudelo" by mistake. They were actually after "One Armadillo"...

But if that's right FIFA would be ruling the contract is valid, not invalid. In other words obliging us to honour a nullified contract that has been frustrated by another party.
Bizzare. And if true we'd surely say to the lawyers preparing the contract 'why didnt you tell us that we are liable to pay a player that might not be able to play for us?'
Sounds like we were either incredibly reckless or someone was negligent (at first blush).

Not a cock up. Signing a player to go on a 6 month loan is generally considered by established premier league teams as good business. If it takes a year to sort the work permit who gives a damn. Hes still worth more than we paid for him.
Selling a player for 2m and spunking an extra 18m to get him back is a cock up......imagine this board if that had happened to stoke today.

Which side of the coin would the op prefer.
1 We missed out on signing him. Another European team buys. Scores goals and potentially we miss out on a player worth several million.
2 Current situation. Little outlay. Goes on loan and scores goals. It would then be too embarrasing for a second wp to be turned down.
If he doesnt set the world on fire during his loan period we still own his registration and we can offload to a European team covering our outlay.
Cant lose.

Correct and after MH's confirmation that Juan is a stoke asset and available for loan like some of us said on twitter and here the original poster of this thread might want to apologise to one or two individuals dare I say the CEO and head of recruitment/scouting for starters

Won't we just wait until he plays enough internationals to qualify for a permit then bring him back from loan , assuming we have signed him of course ?
