The blokes a dickhead if he thought there would be no backlash , and as for where he lives , that`s a scouse stronghold if ever there was one. most in that area are blue or red scouse fans.

The sheer stupidity of some people never ceases to amaze me. A public figure earning a reputed £1 million a year spits through his window in the direction of a car which also has an open window without thinking it may have serious consequences for him. A bloke decides to engage in a bit of "banter" with a public figure - that I can understand - and to be fair he doesn't seem to have gone OTT in what he said. What I don't understand is that he then commits an offence by filming it when driving - and then posts the video on the internet - AND IS THEN SURPRISED ABOUT RECEIVING DEATH THREATS ON SOCIAL MEDIA AND A VISIT FROM THE POLICE! Not everybody is blessed with the intellect of the late great Stephen Hawking - but the two main characters in this little drama are a reminder of just how stupid the "average" bloke can be at times. The driver who filmed the incident can count himself lucky that the police have, apparently, decided to take no action against him. I forsee a lot of drivers who use a mobile phone when driving and who correctly face prosecution, using this case as a reason why they should not be prosecuted. If I were the police I would swiftly reconsider the decision not to prosecute this idiot.

I think he should get the sack if we were talking about somebody like Joey Barton he'd already be sacked, it's only because he has this light-hearted, friendly scouse persona he's hanging in there. I just don't see why you would do it, you're in a car - wind your window up, put your foot down a bit. If somebody in the car next to me on the motorway was hurling abuse at me, I'd put the window up and I'd not be able to hear them. The guy goading him is an idiot, but this is football - it happens.

There is clear evidence that the driver in charge of the vehicle was filming and that the vehicle was moving at the time, how much more evidence is required. As stated above, this either sets a precedent in law or demonstrateable incompetence by the police authority dealing with the case.

It is enough evidence in a court of law to charge a man because it looks like he's holding a phone, and you can't actually see or prove it. Therefore = no fine.
