Their HR department should be sacked for incompetence, I have been contracting for nearly 15 years now each new contract I have to prove I am eligible to work in the UK before I interview potential employers Not sure why they didn't do this or go through applying for a work permit if he gets one he gets the job, if he is refused a work permit he has to turn the job down and they would have saved 120k...

The tribunal awarded the sum because he was in possession of a post graduate work permit, which legally permits him to work in Canada for 3 years. The company turned him down because he couldn't prove permanent residency, which legally isn't necessary for employment if they have a work permit anyway.
The company themselves have now removed the question about permanent residency from their applications, as they accept they shouldn't have been asking it in the first place.
