It's not an automatic jail term Shirley? There must be aggravating features. Deliberate refusal with higher culpability (no reason to not provide a sample) and great harm (driving impaired or like a knob irrespective of drink) makes it a Class 1 Failure to Provide a Specimen of breath (which he allegedly did twice) which carries a mandatory 12 week custodial sentence.

From what I can see it was revised in April 2017 that if there is no excuse and you are found driving dangerously the starting point is a 12 week sentence. Which based on the fact the judge has said this will be the basis of any sentence, we have to assume to be the charge. EDIT: found it www.fitzgerald-solicitors.co.uk/motor-law-section/fail-to-provide-a-specimen/

The judge also advised Saunders that if he pleads guilty it could make a "significant difference" to the sentence he received, but Saunders has still chosen to deny the charges instead.
In other words, he's been told specifically by the judge that it will be custodial and then given a chance by the judge to possibly avoid that, but has now waived that opportunity by choosing to plead not guilty.
In short...he's been a fucking idiot by drink driving, a fucking idiot by refusing to give a breath test, a fucking idiot by then refusing to give a sample at the station and then compounded it all by being a fucking idiot by not taking the judge's advice. Thus proving beyond all doubt what we all knew about him anyway i.e. he's a fucking idiot!
FYI, the dangerous driving charge (which had been added to the charge of failing to provide a roadside test and a breathalyser test at the station), was discontinued by the CPS on Friday

If he chooses to use those factors in his defence then of course it could change the outcome.

You've just taken 2 completely unrelated matters and decided to conflate them for no apparent reason (other than to allow yourself a little soapbox again) and make a point that has no relevance to this thread whatsoever.
Well done you!

Why bring gazza into this he wasn't the one refusing to give a breath test? Quite simply because so many on another thread defending him and Dean Saunders I hope he gets done comment . Gascoigne 4 times over the limit, then arrested for cocaine possession whilst on trial and avoids prison and some still call him a legend , assault, racism but hey it's Gascoigne. One rule for him on another thread. Ironic you use the term bellend when some defend one as some kind of hero yet someone they don't like because he has a whiny voice deserves what's coming to him. Is quite a simple comparison but maybe not as simple as I realised for some individuals. Hope that goes some way to helping you understand .

Saunders hasn't claimed to have addiction problems or mental health problems i.e. the 2 very things that some (not all) feel sorry for Gazza for. THAT'S what people were saying on the other thread i.e. they felt sorry for him for the issues he has. I don't recall anyone, anywhere saying that they think he should get off any punishment for his offences because he's a "Legend"..you've just made that up in that tiny, little mind of yours and then chucked it into a completely unrelated thread.
You've taken 2 situations that aren't alike in any way, shape or form and then asked why they aren't being given the same treatment by people on here. Bizarre, idiotic, completely illogical and just utterly stupid on your part.
People feel sorry for Gazza because of his addictions and mental heath issues People don't feel sorry for Saunders' addictions and mental health problems because he doesn't have them.
Is that simple enough for even you to understand?
Now why don't you piss off and let the grown ups talk.

Of course, he may have decided to plead not guilty because he's errr not guilty. Would an off the cuff sentencing remark by a District Judge make you plead guilty if you weren't? I've won many a fail provide trial because the police messed up somewhere.

I've won many a fail provide trial because the police messed up somewhere. Perfectly fair comment. Apparently his reason for refusing to give the breath test was due to asthma (although the police say he didn't disclose that as a reason for him to not take it at the time, and the bodycam CCTV also doesn't indicate he did..i believe if you have a reasonable reason behind not taking the test, then you have to declare it at the time?). He also refused to give a sample at the station (which i'd guess asthma isn't really an excuse for)... Now, while both of those seem fairly clear cut (either he did or didn't do the breath test and sample) yes, police errors/screw ups of technicalities are of course possible. If he gets off on a technicality however, that wouldn't alter him being a fucking idiot....he'd simply be a fucking idiot that got off due to bigger fucking idiots
